The tribunal also concluded that the charge of Genocide requires further investigations. Eye witnesses included several escapees from the final week of Sri Lanka offensive in the Mullaitivu "No Fire Zone" where more than 20,000 Tamil civilians were allegedly slaughtered by Sri Lanka Army (SLA) training heavy weapons on them.

In a damning report citing top scientific experts, Philip Alston, UN Special Rapporteur on Extrajudicial Killings, dismissed the Sri Lankan Government"s claims that the footage shown by Channel 4 had been fabricated. He urged Colombo to allow UN experts to investigate persistent allegations of war crimes in the final stages of its three-decade civil war.

The number of persons claimed by dengue fever may be more as the cause of the death of some patients has not been found out, the sources added. Lack of preventive measures, medicine, insufficient number of doctors and the disregard shown by the government are the causes for the spread of dengue fever in Jaffna penisula, civil society organizations said.


The regional hospitals in the peninsula keep sending the dengue patients to Jaffna Teaching Hospital which can hardly accommodate all of them.

Chinese environmental protection agency workers take water samples after diesel spilled from a broken pipeline into the river .

BEIJING: Two tributaries of China's Yellow River have been "seriously polluted" by an oil spill, further contaminating badly tainted drinking water resources, the government said Tuesday.

Up to 150,000 litres (40,000 gallons) of diesel spilled into the Chishui and Wei rivers on Wednesday last week after a pipeline operated by China's largest oil producer, China National Petroleum Corp., ruptured, state media said.
"Due to this incident, the Chishui river was seriously polluted and the Wei river was relatively seriously polluted," the government in northern Shaanxi province said in a statement posted Tuesday on its website.

But it said the pollution on the Wei river had been "effectively controlled".

Water quality on the two rivers had on Monday reached grade five, the worst level in China's pollution monitoring scale, after falling off the register following the oil spill, it said.

Level five water is unfit for drinking, but can be used for agricultural purposes, according to government standards.
The two rivers flow into the Yellow River, one of China's longest rivers and the source of drinking water for millions of people, including residents of eight cities that lie downstream from the oil spill, Xinhua news agency said.
On Sunday, diesel was detected in water in the Sanmenxia reservoir on the Yellow River in neighbouring Henan province, it said.
In an effort to contain the pollution, authorities shut down electricity production on the Sanmenxia dam in an effort to keep the contamination from flowing downstream to the cities of Zhengzhou and Kaifeng, the report said.  The two cities, with a total population of nearly 3.5 million people, get up to 95 per cent of their tap water from the Yellow River, the report said. Residents in the cities have long depended on bottled water for drinking.

More than 30 years of unbridled economic growth have left most of China's lakes and rivers heavily polluted, while the nation's urban dwellers also face some of the world's worst air pollution.

Several British Members of Parliament participated in a debate on Sri Lanka's internment camps, Wednesday 28 October for nearly 3 hours starting from 2:30 p.m. Many MPs cited the inhumane conditions under which more than 250,000 Tamil civilians are being kept in military supervised internment camps in Sri Lanka and called for the termination of GSP+ trade benefits and suspension of Sri Lanka from British Commonwealth. New York: Bruce Fein, former Associate Deputy Attorney General of the United States, speaking for the Counsel for a U.S. Tamil Group, Thursday afternoon 3:00 p.m. submitted to United States Attorney General, Mr Eric Holder, the Model Indictment charging U.S. citizen and U.S. green card holder are Gotabaya Rajapaksa, Sri Lanka's Defense Secretary, and Sarath Fonseka, Sri Lanka's Army Commander, respectively for genocide, war crimes and torture against Tamils in Sri Lanka. The Counsel urged the Department to open a grand jury investigation into the crimes, based evidence amassed in the three volume 1000-page document which the Counsel said "amply satisfies the Department's threshold for commencing a criminal investigation."

RE: Investigation of U.S. citizen and U.S. green card holder for genocide, war crimes, and torture against Tamils in Sri Lanka

Dear Mr. Attorney General:

I represent Tamils Against Genocide (TAG), a non-profit organization dedicated to promoting the enforcement against a United States citizen and a United States green card holder of the Genocide Accountability Act of 2007 (GAA), the War Crimes Act, and prohibition of torture. The U.S. citizen and U.S. green card holder are Gotabaya Rajapaksa, Sri Lanka?s Defense Secretary, and Sarath Fonseka, Sri Lanka?s Army Commander, respectively. I strongly urge the Department to open a grand jury investigation into these crimes based on the enclosed three-volume, 1,000 page proposed indictment that I have prepared. I would submit that the evidence of genocide, war crimes, and torture amassed in the three volumes amply satisfies the Department?s threshold for commencing a criminal investigation.

The following points, among others, demonstrate the urgency of investigating the alleged crimes:

1. The model indictment charges Gotabaya Rajapaksa and Sarath Fonseka with 12 (twelve) counts of genocide under the GAA. That legislation was spearheaded by Senator Richard Durbin (D. Illinois). It was supported by President Barack Obama, Vice President Joe Biden, and Secretary of State Hillary Clinton. The GAA is codified at 18 U.S.C. 1091. The maximum punishment is death. Both proposed defendants are charged with command responsibility for genocidal acts perpetrated by their subordinates in the Sri Lankan security forces.

2. The GAA applies to genocide irrespective of the place of its occurrence and irrespective of whether the accused is a U.S. national. The model indictment, nevertheless, singles out Gotabaya Rajapaksa and General Fonseka as defendants because the former is a U.S. citizen and the latter is a green card holder. These facts strengthen the political justification for the genocide investigation because the United States has been vocal with Serbia, Bosnia and other nations about policing and punishing their own citizens or residents for genocide. The model indictment is not asking the United States to be the genocide policeman of the world.

3. Under the GAA, genocide is defined as an attempt to physically destroy a group in whole or in substantial part because of race, religion, ethnicity, or nationality, as such, by employing the following tactics: extrajudicial killings or disappearances; the infliction of serious bodily harm; or, the creation of conditions of life intended to cause the physical destruction of a racial, religious, ethnical, or national group in whole or in substantial part, for example, by starvation, denial of medical care, and encouraging disease by denial of medicines.

4. The model indictment charges Rajapaksa and Fonseka with genocide of Tamils in twelve discrete geographic areas. The time frame is from December 6, 2005, when both assumed their government positions, to the present. The indictment chronicles more than 3,750 extrajudicial killings, approximately 30,000 Tamils suffering serious bodily injury, and more than 1.3 million displacements (a number far exceeding displacements in Kosovo which lead to genocide counts before the International Tribunal for the former Yugoslavia).

5. Count twelve of genocide is indistinguishable from the genocide of 7,000 Bosnian Muslim males in Srebrenica, which had been declared a safe zone by Bosnian Serbs. Count twelve charges Rajapaksa and Fonseka of bombing and shelling 350,000 Tamil civilians into one large ?safe area,? and, since January 21, 2009, killing and maiming the Tamils who had amassed there by aerial bombing and artillery. In the month of January, according to the model indictment, 750 Tamils have been massacred and more than 2,250 have been seriously injured. On the BBC, on Feb. 2, Rajapaksa declared that nothing should live or breathe outside the Orwellian ?safe area.? Thus, one hospital outside the area has been bombed three times, including by cluster bombs. More than 1,000 Tamils are in detention camps, and reports of rape have already emerged.

6. Other exemplary genocidal events charged in the indictment include the Sinhalese Buddhist slaughter of five Tamil students and seventeen Action Against Hunger aid workers in 2006; mass graves; and, Tamil disappearances into white vans without license plates every five hours.

7. Every member of the Sri Lankan security forces is Sinhalese. There are no Tamils. No member of the security forces since Rajapaksa and Fonseka assumed their respective positions has ever been prosecuted or punished for atrocities against Tamils, including torture or murder. Indeed, in more than 60 years, only one prosecution has been pursued for rape, murder, torture, or other crimes against Tamils, and that one isolated exception was for peculiar reasons.

India, Sri Lanka to sign MOU next month for undersea power line

The Governments of India and Sri Lanka are to sign a Memorandum of Understanding (MOU) for the construction of an undersea power line between South India and Thalaimannaar in Sri Lanka next month. The construction work of the power line will start next year and the estimated project cost is $ 500 million, according to Power and Energy Ministry Spokesman. He said that the cost of the project will be shared by both countries, and added that the power line would provide opportunity for both countries to transmit power either ways as the necessity arises. Around 500MW to 1000MW electricity will be purchased from India under the first and second stage of the project and Sri Lanka is expected to sell its electricity to India from 2018, he further said.About 5400 MW electricity is to be added to the national grid by 2018 then the national supply will be more than the requirements of the country. The power projects underway such as Nuraichchoalai, Upper Kotmale, Trincomalee and Kerawalapitiya will add 900MW, 150MW, 1000MW, 750 MW electricity respectively to the national grid. At present electricity capacity in the country is 2400MW and the electricity demand will be increased by 10% yearly, he said.


Power gain for India and Coconut factory and Thermal plant for China ,all these gained are the fruits of the bloody war , now we are clear over the fact as in why both India and China are with Sri Lanka all the way protecting the government from facing war crime charges .

A senior UN diplomat was expelled from Sri Lanka in July for providing details to the international community of mass killings of civilians during the final battles against the Tamil Tigers, The Guardian newspaper in Britain reported Saturday. Peter Mackay, an Australian citizen, was given two weeks to leave the country for providing detailed rebuttals of Sri Lankan government’s "wartime propaganda." The diplomat is seen as a legal timebomb by the Sri Lankan government as he could personally take the stand and testify that the army shelled non-combatants – action considered to be a war crime under international law, the paper said.


Why is Ban Ki Moon still reluctant to allow Sri Lankan Government to face the war crime charges, what more evidence is U.N expecting or is he expecting a green light from China .

Sri Lanka is never going to allow any media in the so call safe zone where over 300 000 ethnic Tamils are kept as "suspects", which include, Mothers, Children, babies and Elderly.

Philip Alston, the UN Special Rapporteur on extra-judicial, summary or arbitrary executions, commenting on the video clip aired in British Channel-4 TV, allegedly showing Sri Lankan troops executing prisoners, stressed the need for an investigation, AFP reported. The images, which Alston described as "horrendous," indicate a serious violation of international law if found to be authentic, AFP reported Alston as saying. The video showed victims stripped naked and their hands crossed and tied behind their backs, when they were executed.
