Several British Members of Parliament participated in a debate on Sri Lanka's internment camps, Wednesday 28 October for nearly 3 hours starting from 2:30 p.m. Many MPs cited the inhumane conditions under which more than 250,000 Tamil civilians are being kept in military supervised internment camps in Sri Lanka and called for the termination of GSP+ trade benefits and suspension of Sri Lanka from British Commonwealth. Joan Ryan, the Labour MP for Enfield North and a vice chair of the Labor party, initiated the debate.

Rajapaksa is the current Guru for Burmese Junta

Burma was the first foreign country visited by President Mahendra Rajapaksa after his victory over the Tigers last May, and his own government website reported that one of his aims was to advise the Burmese generals on how to defeat their own ethnic insurgents, learning from Sri Lanka’s methods.

Bruce Fein, former Associate Deputy Attorney General of the United States Submits War Crimes Charges against Sri Lanka's Defense Secretary and Army Commander

New York: Bruce Fein, former Associate Deputy Attorney General of the United States, speaking for the Counsel for a U.S. Tamil Group, Thursday afternoon 3:00 p.m. submitted to United States Attorney General, Mr Eric Holder, the Model Indictment charging U.S. citizen and U.S. green card holder are Gotabaya Rajapaksa, Sri Lanka's Defense Secretary, and Sarath Fonseka, Sri Lanka's Army Commander, respectively for genocide, war crimes and torture against Tamils in Sri Lanka. The Counsel urged the Department to open a grand jury investigation into the crimes, based evidence amassed in the three volume 1000-page document which the Counsel said "amply satisfies the Department's threshold for commencing a criminal investigation."

Full text of the letter submitted with the model indictment follows:

February 5, 2009

Honorable Eric H. Holder

United States Attorney General
U.S. Department of Justice
950 Pennsylvania Avenue, NW
Washington, D.C.

RE: Investigation of U.S. citizen and U.S. green card holder for genocide, war crimes, and torture against Tamils in Sri Lanka

Dear Mr. Attorney General:

I represent Tamils Against Genocide (TAG), a non-profit organization dedicated to promoting the enforcement against a United States citizen and a United States green card holder of the Genocide Accountability Act of 2007 (GAA), the War Crimes Act, and prohibition of torture. The U.S. citizen and U.S. green card holder are Gotabaya Rajapaksa, Sri Lanka?s Defense Secretary, and Sarath Fonseka, Sri Lanka?s Army Commander, respectively. I strongly urge the Department to open a grand jury investigation into these crimes based on the enclosed three-volume, 1,000 page proposed indictment that I have prepared. I would submit that the evidence of genocide, war crimes, and torture amassed in the three volumes amply satisfies the Department?s threshold for commencing a criminal investigation.

The following points, among others, demonstrate the urgency of investigating the alleged crimes:

1. The model indictment charges Gotabaya Rajapaksa and Sarath Fonseka with 12 (twelve) counts of genocide under the GAA. That legislation was spearheaded by Senator Richard Durbin (D. Illinois). It was supported by President Barack Obama, Vice President Joe Biden, and Secretary of State Hillary Clinton. The GAA is codified at 18 U.S.C. 1091. The maximum punishment is death. Both proposed defendants are charged with command responsibility for genocidal acts perpetrated by their subordinates in the Sri Lankan security forces.

2. The GAA applies to genocide irrespective of the place of its occurrence and irrespective of whether the accused is a U.S. national. The model indictment, nevertheless, singles out Gotabaya Rajapaksa and General Fonseka as defendants because the former is a U.S. citizen and the latter is a green card holder. These facts strengthen the political justification for the genocide investigation because the United States has been vocal with Serbia, Bosnia and other nations about policing and punishing their own citizens or residents for genocide. The model indictment is not asking the United States to be the genocide policeman of the world.

3. Under the GAA, genocide is defined as an attempt to physically destroy a group in whole or in substantial part because of race, religion, ethnicity, or nationality, as such, by employing the following tactics: extrajudicial killings or disappearances; the infliction of serious bodily harm; or, the creation of conditions of life intended to cause the physical destruction of a racial, religious, ethnical, or national group in whole or in substantial part, for example, by starvation, denial of medical care, and encouraging disease by denial of medicines.

4. The model indictment charges Rajapaksa and Fonseka with genocide of Tamils in twelve discrete geographic areas. The time frame is from December 6, 2005, when both assumed their government positions, to the present. The indictment chronicles more than 3,750 extrajudicial killings, approximately 30,000 Tamils suffering serious bodily injury, and more than 1.3 million displacements (a number far exceeding displacements in Kosovo which lead to genocide counts before the International Tribunal for the former Yugoslavia).

5. Count twelve of genocide is indistinguishable from the genocide of 7,000 Bosnian Muslim males in Srebrenica, which had been declared a safe zone by Bosnian Serbs. Count twelve charges Rajapaksa and Fonseka of bombing and shelling 350,000 Tamil civilians into one large ?safe area,? and, since January 21, 2009, killing and maiming the Tamils who had amassed there by aerial bombing and artillery. In the month of January, according to the model indictment, 750 Tamils have been massacred and more than 2,250 have been seriously injured. On the BBC, on Feb. 2, Rajapaksa declared that nothing should live or breathe outside the Orwellian ?safe area.? Thus, one hospital outside the area has been bombed three times, including by cluster bombs. More than 1,000 Tamils are in detention camps, and reports of rape have already emerged.

6. Other exemplary genocidal events charged in the indictment include the Sinhalese Buddhist slaughter of five Tamil students and seventeen Action Against Hunger aid workers in 2006; mass graves; and, Tamil disappearances into white vans without license plates every five hours.

7. Every member of the Sri Lankan security forces is Sinhalese. There are no Tamils. No member of the security forces since Rajapaksa and Fonseka assumed their respective positions has ever been prosecuted or punished for atrocities against Tamils, including torture or murder. Indeed, in more than 60 years, only one prosecution has been pursued for rape, murder, torture, or other crimes against Tamils, and that one isolated exception was for peculiar reasons.

8. The model indictment relies on evidence obtained from affidavits, court documents, and contemporaneous eye-witness reporting from media sources, for example, the BBC.

9. If Rajapaksa and Fonseka are indicted, Sri Lanka would be obligated to extradite them to the United States under the Genocide Convention of 1948 and implementing legislation.

I am eager to meet with you or your staff to discuss the three-volume enclosure at your earliest convenience.

Sincerely,
Bruce Fein

Attorney for Tamils Against Genocide

silence of United Nation is unacceptable

Once again the Silence of United nation is bringing the numbers of casualties high in Sri Lanka, their failure to react on time in Sudan has brought high number of civilian casulaties and now in the issue of Sri Lanka, where Rajapaksa Government is holding 300 000 innocent civilians for "one reason"  letting them to die with no food and medical aid .
Not to deny that U.N is reminding Sri Lankan Government , its attitude towards the innocent civilians is wrong and that the civilians should not be held for too long .
Looking at how U.N deals such issues with Sri Lanka, seems more like a classroom senario between a Teacher and Student,
teacher remidning the student over his assignment and the student delaying the submission .
Which will be going on for another month that will come to a year and nothing will change accept for the numbers, from 300 000 to 3000, for every lives at stake in the concentration camp, United Nations and the attitude of the respective officials are solely responsible for their negligence .

The annual Pongu THamil  which will be celebrated by the Lankan Tamils in north could be another focus of Rajapaksa not wanting such events to take place in north ,as it could bring back the unity and strengths of Tamils , the current war no doubt held with a hidden agenda as in not to just fight the rebels alone but to mainly wipe out the population in the north of Sri Lanka for commercial purpo$e .

Prof. Chellany admits

Prof. Chellany admits that Rajiv Gandhi’s mind was poisoned by J R Jeyawardane, making him retract from the promised support to Eezham Tamil aspirations and thus bringing in the rift between Tamils and India. Rajiv was made to believe that an Eezham would pave way for a greater Tamil country

Simply a fear by the Hindian party which did not want to witness a growing ethnic power that HIndian Congress and Rajiv could have decided to go against Tamil aspiration in Lanka

Sri lanka government grants 15 years tax relief to Indian organizations.

Government has informed it would grant 15 years’ tax relief to the Indian organizations investing in the Northern areas of Sri Lanka. This benefit is given to the Indian organizations massively to expand investment activities in the many parts of north in Sri Lanka was stated.

Recently 500 million dollars worth of Coal mine power production centre was constructed by an Indian government in the Sambur locality, at Tricomalee. In the meantime another Indian organization, had obtained permit to conduct an oil research workshop for a value of 400 million dollars
The inhabitants Tamils of the north of Sri Lanka( Tricomalee) were disturbed ,shot ,raped and buried to death and some 300 000 are forced inside concentration camps to face natural death and the Sri Lankan Government has the guts to offer Tamil land to Indian Investors to invest in.

Isnt it like suking the Tamils blood...will this sin ever allow the investors freely, or can they ever make profit in the blood soaked land ?

If Iran agrees to allow UN visit to new nuclear plant what is stopping Sri Lanka allowing U.N offcials to view the conditions of the Tamil people in the concentration camp ?

If Iran agrees to allow UN visit to new nuclear plant what is stopping the Sick Sri Lankan Sinhalese officials not allowing U.N or any international media to view the concentration camp ?

What is it that Sri Lankan Government is moving away from ?

Are the people in the concentration camp still alive ?

It was initially 300 000 , what is the number now ?

Why is it that the Sri Lankan Government is planning to touch the Tamils bank account now ,stating that
"'the account holders might be dead or scattered out of Sri Lanka""

So could it be that the Sri Lankan Government was eyeing  the 3000 million rupees deposited in the bank in the north of Lanka that the innocent Tamils were forced in the concentration camp to face death ?

Sri Lankan Sinhalese Government - Dirty Political Robbery

Sri Lankan Government which is begging for money from overseas aid is now planning to rob formally, the untouched account of the Tamils in north worth 3000 million rupees , the north of Sri Lanka currently a death zone, majority of innocent Tamil whom were slaughtered to death and some scattered all over.

The 300 000 over Tamils in north  forced in the concentration camp as suspects, which includes, women, senior citizens , infants and many more ,having these people locked in concentration camps, starving them to face natural death. Hundreds are dieing of hunger and no medical attention
Whats next ? to penetrate into the untouched bank account of the Tamils and rob their money to feed the fellow Sinhalese in Sri Lanka
Thats the ongoing action of the atrocious Rajapaksa Government.
